Psychological Perception of Marriage Contracts: Reframing the Stigma
(Adapted from MAKMEL Law Firm’s Legal Video Series)
The Typical Reaction
In Ukraine, prenuptial agreements remain relatively uncommon—not due to a lack of legal awareness, but because of psychological perception. Most couples react with hesitation: “Why get married if we are already planning how to break up?” The agreement is often misconstrued as a sign of distrust or cold calculation.
A Shift in Perspective
A marriage contract is not a divorce strategy; it is a cohabitation plan built on mutual clarity and clear rules. Mature adults should be able to discuss financial expectations calmly—before, during, and throughout marriage.
Relationships naturally evolve over time. A marriage contract provides both partners with legal certainty and protection, regardless of how life unfolds.
When Financial Discussions Cause Tension
If discussing property rules creates tension or your partner avoids the subject entirely, consulting a relationship therapist can be immensely helpful. The goal is not simply to “fix a problem,” but to learn how to communicate openly about complex, sensitive topics together.
When Can You Sign a Contract?
A marriage agreement can be executed prior to official marriage registration or at any point during marriage up until divorce. If you do not have an agreement yet, it is never too late to establish one.
