Purchasing Property Before Marriage: A Legal Gray Zone
Purchasing property during unregistered cohabitation is a legal gray zone where your rights to the asset must still be proven in court.
Under Ukrainian law, “civil marriage” carries no automatic legal presumption of joint property ownership. Only one date holds legal authority: official registration at the Civil Status Acts Registration Office (DRACS). Everything acquired prior to that date remains the separate personal property of the individual buyer—even if you lived together for three years and maintained a shared household.
To prove your right to such property in court, documentary evidence of your direct financial contribution is essential:
Bank wire transfers
Account statements and signed receipts
Written loan or contribution agreements
Verbal assertions such as “we bought it together” carry no legal weight and will be rejected by the court without supporting documentation.
